A stable union is recognized by the constitution as a family entity, whether in a hetero or homosexual relationship. Therefore, foreigners who have a stable union with Brazilian citizen are entitled to a visa.

How to regularize the Stable Union with a foreigner?

To obtain a stable union visa for foreigners, it is recommended that the union be formalized. The stable union can be regularized through public deeds, private contracts, or judicial recognition.

Thus, for public deeds, it can be done at the Notary’s Office, where the couple will need to attend personally. The private contract is also made at the Notary Office and can be used in lawsuits.

  • Income Tax Declaration of the insured, in which the interested party appears as his dependent;
  • Testamentary provisions;
  • Facebook, Instagram, and other social media profiles;
  • Fotos em eventos sociais, reuniões, bem como em associações, ou outras entidades como casal;
  • Handwritten love letters or romantic declarations;
  • Constant Note in the Work Card, made by the competent body;
  • Special declaration made before Notary Public (public deed declaring economic dependence);
  • Anotação Constante de Ficha, bem como Livro de Registro de Empregados;
  • Birth Certificate of a shared child;
  • Religious Marriage Certificate;
  • Evidence of shared domestic duties and the existence of partnership or communion in acts of civil life;
  • Power of attorney, as well as guarantee reciprocally granted;
  • Joint bank account;

How to obtain a stable union visa for foreigners in Brazil

The stable union visa is recognized as a type of family reunion visa. The application must be requested at the National Immigration Council, where the applicant must go with the necessary documents in hand. However, applicants that are unable to attend the Council themselves may appoint a representative to submit the application.

After obtaining the visa, the foreigner in a stable union can not only reside but also work or travel throughout the national territory, since he obtains all the same rights as Brazilian citizens.

Documents required to apply for the stable union visa for foreigners in Brazil

The documents required for applying for the stable union visa for foreigners in Brazil according to the Ministry of Justice website are:

  • Application made through an electronic form duly completed on the Federal Police website (available at Obtain Residence Permit);
  • 1 (one) 3×4 photo, recent, color, white background, plain paper, looking forward (if the Federal Police’s biometric data collection system is unavailable, attendance may be required);
  • Declaration of electronic address and other means of contact, preferably accompanied by a simple copy of proof of residence;
  • Travel document or official identity document;
  • Criminal background certificates or equivalent documents issued by the competent judicial authority where you have resided in the last five years;
  • Declaration, under penalty of law, of the absence of a criminal record in any country;
  • Birth or marriage certificate to prove the relationship between the applicant and the Brazilian or immigrant beneficiary of a residence permit, or a valid document that proves the bond;
  • Identity document of the Brazilian or immigrant beneficiary of a residence permit, with which the applicant wishes to meet;
  • Proof of the stable union relationship between the applicant and the Brazilian or immigrant beneficiary of a residence permit (click here);
  • Joint declaration of the spouses or partners, under the penalties of the law, regarding the continuity of effective union and coexistence;
  • Documents that prove the guardianship, trusteeship, or custody of Brazilian citizenship, when applicable;
