First, to obtain a permanent visa for marriage with a Brazilian, it’s necessary that the foreigner is in fact married to a Brazilian, that is, that the union is duly legalized. It’s also important that the foreigner interested in the visa present the civil capacity required by the Brazilian Government. - Certified copy of the birth certificate of the foreign child(ren), legalized with the Brazilian consular authorities abroad, translated by a sworn public translator or consular certificate (when is the case);
- Opinion of the union body;
- Certified copy of the marriage certificate with a Brazilian;
- Proof of collection of the stipulated fee, in original (per Person). Thus, it will be collected through the GRU/FUNAPOL tab;
- Term of custody and guardianship of the person responsible for the minor (foreign child) if he is unaccompanied by his father or mother (when applicable);
- Request through a specific form to be obtained from the Ministry of Justice or the Federal Police (per person);
- Consular declaration clarifying the correct spelling of the name, in view of the discrepancies contained in the documents presented (when applicable);
- Certified copy of the Brazilian spouse’s identity card;
- A declaration that you are not legally or legally separated from your Brazilian spouse. It must therefore be signed by the couple, with a notarized signature;
- Transcription of the marriage certificate, for the Brazilian civil registry under the terms of § 1 of art. 32 of the Public Records Law – Law n. 6015/73 (when applicable);
- Certified copy of all passport pages (per person).
In this sense, documents that are in a foreign language need to be legalized at a Brazilian Consulate abroad, in addition to being translated by a sworn translator.
